California Supreme Court Axes Popular Taxpayer Protection Act, Sparks Outcry Over Democracy

On June 20, 2024, the California Supreme Court removed a tax-related measure from the November ballot, marking its first such action since 1999. The measure, supported by over 1.4 million signatures, aimed to require voter approval for any tax increases by the state Legislature and a two-thirds majority for local tax hikes, rather than a simple majority. The court unanimously agreed with Governor Gavin Newsom and the Democratic-controlled Legislature on "technicality" that this would constitute a constitutional "revision", not just an "amendment".
This decision is seen as a victory for Newsom, Democratic leaders, and their allies in public employee unions, while being a significant setback for the California Business Roundtable and anti-tax organizations like the Howard Jarvis Taxpayers Association. Critics of the seven-member court — six of whom were appointed by Democratic governors, including three by Newsom have denounced the decision as a travesty and a “gut-punch to direct democracy in California.”
"Recent polling has indicated that Californians feel overtaxed, which would have helped the measure’s backers potentially win in November. Fear of that outcome propelled Democratic officials to ask the Supreme Court to block the measure from reaching the ballot. They won the case exactly one week before the final deadline for determining what will make the ballot."
